Nevada Privacy Policy

1. Introduction and Scope

This Nevada Consumer Health Data Privacy Notice describes how Insight Therapy Solutions and its related entities (“we,” “us,” “Insight” or “our”) collects, uses, shares, and protects “consumer health data” of Nevada residents under Nevada Senate Bill 370 (codified at NRS 603A.420 et seq.). This Notice supplements and is separate from our website Privacy Policy and our Notice of Privacy Practices issued under the Health Insurance Portability and Accountability Act (“HIPAA”).

This Notice applies only to consumer health data that is NOT regulated as Protected Health Information (“PHI”) under HIPAA. Information we hold as PHI is governed exclusively by our HIPAA Notice of Privacy Practices, which is made available through our secure client portal at [Portal URL] and to all clients at intake.

2. What We Mean by “Consumer Health Data”

Under Nevada SB 370, “consumer health data” means personally identifiable information that is linked or reasonably capable of being linked to a consumer and that a regulated entity uses to identify the past, present, or future health status of the consumer. For purposes of our website, this may include information indicating that a person is seeking mental or behavioral health services.

3. Categories of Consumer Health Data We Collect

We may collect the following categories of consumer health data through our public website:

  • Identifying information you choose to provide (name, email, phone number) when you contact us to inquire about behavioral health services.
  • Information indicating that you or a person on whose behalf you are inquiring is seeking mental or behavioral health services.
  • Information you voluntarily provide describing the type of service you are seeking (e.g., individual therapy, medication management, group programs).
  • Limited technical information automatically collected (IP address, device type, page activity) where that information could reasonably be linked to a consumer seeking behavioral health services.

We do not currently use third-party analytics, advertising pixels, or behavioral retargeting on our website. If we add any such technology in the future, this Notice will be updated and, where applicable, consent will be obtained prior to collection.

4. Categories of Sources

We may collect consumer health data from the following sources:

  • Directly from you — through forms, email, phone calls, and website interactions you initiate.
  • From third parties only with your authorization — for example, a referring clinician or family member you have designated.
  • Automatically — through the operation of our website (technical information described in Section 3).

5. How We Use Consumer Health Data

We use consumer health data only for the following purposes:

  • To respond to your inquiry.
  • To schedule, deliver, and document services, including verifying your eligibility, licensure jurisdiction, and insurance coverage.
  • To operate, maintain, and secure our website and communications systems.
  • To comply with our legal, regulatory, professional, and ethical obligations.
  • For any other purpose for which you provide specific consent at the time of collection.

6. Categories of Third Parties and Affiliates With Whom We Share Consumer Health Data

We share consumer health data only as described below.

6.1 Service providers under contract

We share limited consumer health data with vendors who provide services on our behalf and who are contractually required to safeguard the data, including:

  • Our website hosting provider — for operation of the website.
  • Our electronic health record (“EHR”) and client portal provider — once you become a client, your information transitions out of the website context and into the HIPAA-regulated portal.
  • Our telecommunications and email providers — for communications related to your inquiry or care.
  • Our payment processor — only if and when you become a paying client; payment processors do not receive clinical detail.

6.2 Affiliated clinicians and entities

We share consumer health data among our employed and contracted clinicians and our affiliated entities only as needed to evaluate, schedule, and deliver behavioral health services. A current list of our affiliated entities is available on request from the privacy contact below.

6.3 Disclosures required by law

We may disclose consumer health data when required by law or legal process, when necessary to protect the rights, safety, or property of clients, staff, or the public, or to respond to an imminent threat to the health or safety of any person.

7. We Do Not Sell Consumer Health Data

Insight does not sell consumer health data. We do not authorize any third party to sell consumer health data on our behalf. If we ever propose to sell consumer health data, we will obtain your separate, informed, written authorization before doing so, as required by Nevada law.

8. Your Rights Under Nevada SB 370

If you are a Nevada resident, you have the right to:

  • Confirm whether we are processing your consumer health data and access that data.
  • Request a list of the categories of third parties and affiliates with whom we have shared your consumer health data.
  • Request that we delete your consumer health data, including by directing our service providers to delete it.
  • Withdraw any previously-given consent to the collection, sharing, or sale of your consumer health data.

We will not retaliate against you, or deny, charge different prices for, or provide a different level or quality of services because you exercised these rights.

9. How to Exercise Your Rights

We will verify your identity using information already in our possession, in a manner reasonably calculated to confirm that you are the person whose data is the subject of the request. If we cannot verify your identity, we will inform you and explain why. We will respond to verified requests within the time frame required by Nevada law (generally within 45 days, with a 45-day extension where reasonably necessary, and with notice of the extension).

10. Appeals

If we decline a request in whole or in part, we will inform you of the decision and the reason. You may appeal that decision by writing to the address in Section 9 within 60 days of our response, marking your appeal “Nevada SB 370 Appeal.” We will respond to your appeal in writing within 60 days. If we deny your appeal, you may file a complaint with the Office of the Nevada Attorney General.

11. Children

Our website is intended for adults. We do not knowingly collect consumer health data through the website from individuals under 13. Parents and guardians of minor clients should contact us by phone or through our client portal rather than the public website.

12. Security

We maintain administrative, technical, and physical safeguards designed to protect consumer health data from unauthorized access, disclosure, alteration, and destruction. No system is perfectly secure, but we take reasonable steps to monitor and improve our safeguards.

13. Changes to This Notice

We may update this Notice from time to time. The effective date at the top reflects the date of the most recent update. Material changes will be communicated by posting the updated Notice on our website with a revised effective date.
